How Your Driver’s License Can Get Revoked
While most people know that driver’s licenses can be suspended, especially when arrested for a DUI, many don’t know that they can be permanently revoked. This punishment typically occurs when individuals have had multiple DUI convictions or have committed other serious offenses.
You may lose your driver’s license if:
- You’ve been convicted of three DUIs
- You’ve accumulated five traffic citations in two years
- You’ve been convicted of numerous serious driving offenses that can include driving under the influence, reckless driving, fleeing the scene of an injury accident, failure to answer a traffic summons, and drag racing
- You’ve failed to appear in court
- You’ve failed to pay child support
In the state of Oregon, you may file a petition to the court to reinstate your driving privileges 10 years after your date of conviction or upon your release from prison. You may also have your license revoked if you fail to provide a breath, blood, or urine sample after a DUI arrest.
Trust Our Former District Attorney
To have your driver’s license reinstated, you’ll need to file a petition and appear in front of a judge. However, it’s fairly common for the District Attorney to object to your reinstatement, which is why you need a Bend driver's license reinstatement attorney who has the experience needed to fight for you. At Baxter Law, LLC, our founder is a former Deputy District Attorney who knows exactly what the DA will be looking for to discount your case and can combat it with a compelling and sound argument.
In restoring your driving privileges, the judge looks at several factors, including:
- The nature of your original conviction
- Criminal and non-criminal behavior prior to and after the conviction
- A psychological evaluation that determines whether you’re a threat to the public’s safety
What Happens After Your Petition is Granted
If a judge ends up granting your petition, you’ll need to head to the DMV and apply for a new license. The DMV will demand you to meet certain requirements that other non-convicted drivers don’t need to meet, including installing and using an ignition interlock device for five years.
If you need help filing your petition and are ready to appear before a judge, we’re available to help. We can also provide legal representation if your license was suspended after a DUI arrest and you’d like to contest the suspension.
Our Bend driver's license reinstatement lawyers are available to help if your Oregon driver’s license was revoked. To learn about the solutions we can provide for your complex legal matters, call (541) 238-9210.
